As a prosecutor, Mr. Blackmon’s role is multifaceted. The prosecutor’s role is not just that of an advocate, but rather has been described as a person “… who is a quasi-judicial officer, representing the People of the state, and presumed to act impartially in the interest only of justice” (State v. Case, 49 Wn.2d 66, 70 (1956)). As such, the prosecutor has a great responsibility to the community. The prosecutor must make sure that rights of the accused are protected, not just by law enforcement, but by the State, the defense attorney, and the court as well. I believe my experience as a prosecutor makes me uniquely qualified to serve on the District Court bench. The following quote from the United States Supreme Court has helped guide me in my career to be a fair and neutral prosecutor:
“The United States Attorney is the representative not of an ordinary party to a controversy, but of a sovereignty whose obligation to govern impartially is as compelling as its obligation to govern at all; and whose interest, therefore, in a criminal prosecution is not that it shall win a case, but that justice shall be done. As such, he is in a peculiar and very definite sense the servant of the law, the twofold aim of which is that guilt shall not escape or innocence suffer. He may prosecute with earnestness and vigor–indeed, he should do so. But, while he may strike hard blows, he is not at liberty to strike foul ones. It is as much his duty to refrain from improper methods calculated to produce a wrongful conviction as it is to use every legitimate means to bring about a just one.” Berger v. United States, 295 U.S. 78, 88 (1935).
I’ve found Mr. Blackmon to apply the law fairly and even-handedly. He has taught me not only procedures relating to the law but the customs and traditions underlying Chelan County’s legal system. This includes a commitment to both the letter and spirit of the law and transparency in adversarial proceedings. It is because of my experience working with Mr. Blackmon I am confident there is no better choice for district court judge.
